Spanish man gets suspended 15‑month sentence for hate‑speech against Moroccan waiter

A court in Cantabria sentenced a man to a 15‑month and one‑day term of imprisonment, suspended on condition of no further offenses, for repeatedly addressing a Moroccan waiter in Santander with xenophobic insults such as "moro de mierda" and urging him to return to his country. The abuse was directed both in the presence of other customers and workers and later relayed to colleagues when the victim was absent.

The prosecution, which originally sought 18 months, applied a mitigating factor after the defendant paid €1,539 in compensation and expressed remorse. In addition to the suspended jail term, the judge imposed a fine of €813, a civil indemnity of €4,515, and a five‑year ban on any professional, educational, sports or leisure activities. The penalty reflects the court’s stance on continuous hate‑based offenses.
