Spanish museums await implementation of reduced cultural VAT
Spanish cultural institutions, including the Guggenheim Bilbao and the Museo de Bellas Artes de Bilbao, are awaiting the implementation of a reduced VAT rate for the art sector. Although EU Directive 2022/542 has allowed member states to lower VAT on art, antiques, and collectibles to between 5% and 10% since 2022, Spain has yet to establish a date for its transposition.
Implementing this reduction would increase the purchasing power of public institutions, such as museums and foundations, by reducing the total cost of acquisitions from galleries. However, the Spanish Ministry of Finance has noted that under the Directive, works acquired with this reduced rate may not be eligible for the Special Regime of Profit Margin.
