Spanish property registrars seek up to 400% fee increase
Property registrars in Spain are requesting a significant increase in the cost of obtaining a 'nota simple' (a property information summary). The proposal seeks to raise the current fee of approximately 3 euros to either 9 euros for electronic requests or 12 euros for continuous information, representing an increase of 300% to 400%.
This move follows legal challenges regarding overcharging. A ruling by the High Court of Justice of Extremadura recently questioned these costs, noting that registrars cannot freely determine tariffs without a normative basis. While the ruling specifically addressed one case, it allows affected citizens to claim refunds and may lead to further legal challenges across Spain.
Registrars have argued that technological transformations under Law 11/2023 justify higher fees. However, critics suggest this is an excuse, noting that property information has been processed through electronic systems for decades.
