Spanish prosecution requests dismissal of CDR case under amnesty law

The National Court's prosecution has requested the dismissal of the case against the Committees for the Defense of the Republic (CDR) following the application of the amnesty law. The request seeks the free dismissal of proceedings involving 12 members of the group.

The investigation involved the seizure of substances capable of being converted into explosives. Prosecutors noted that eight of the defendants had previously faced requested prison sentences of up to 27 years for crimes including membership in a terrorist organization and the manufacture of explosives and flammable substances.

The court previously determined that the alleged acts, occurring between November 1, 2011, and November 13, 2023, fall within the scope of the amnesty law as they were linked to Catalan independence. This follows a ruling from the Court of Justice of the European Union (CJEU), which clarified that amnesty is not incompatible with European legislation regarding the protection of terrorism victims.
