Spanish residents face legal disputes over garage access and ownership

In Basauri, a homeowner lost a legal battle against her community of neighbors regarding garage accessibility. After purchasing a larger Dacia Sandero, she found that the existing garage door mechanism struck her vehicle due to its position next to the entrance. She proposed replacing the door with a roller shutter costing approximately 4,500 euros, which would have cost each household about 200 euros. However, the community rejected the proposal, and the Provincial Court of Bizkaia ultimately ruled that the community of owners is not obligated to change the door.

In Ourense, residents of San Antonio are in a standoff with the local council over the regularization of underground parking spaces. Neighbors are seeking a formal resolution regarding the ownership and use of the subsoil beneath Plaza de San Antonio. While the council has suggested administrative concessions, residents argue this is legally unfeasible. Some owners are considering modifying land planning laws to designate the surface as municipal domain and the subsoil for private use, provided they waive claims for damages. Meanwhile, some residents have filed claims for 30,000 euros per parking space to seek compensation for damages caused by the ongoing management vacuum.
