Spanish Supreme Court bans attendance bonuses linked to sick leave

The Spanish Supreme Court has ruled against the use of attendance and punctuality bonuses as a means to penalize employees for sick leave. This decision follows a complaint by the CIG union against the supermarket chain Mercadona.

Mercadona, which distributed 780 million euros in profits to its 112,000 employees this year, had a collective agreement that restricted bonuses for workers who were on common illness leave for more than 30 days. The court found that clauses preventing workers from receiving bonuses because they could not meet minimum effective work requirements due to sick leave were discriminatory.

Legal experts note that both the Supreme Court and the National Court have increasingly viewed using sick leave as a factor in determining attendance bonuses as illegal. This ruling may impact other major Spanish companies that utilize similar incentive structures, such as Repsol, Damm, and Cacaolat.
