Mexico Supreme Court rules on divorce compensation for domestic labor
The Supreme Court of Justice of the Nation (SCJN) in Mexico has established a new legal criterion regarding economic compensation during divorces under the regime of separation of assets. The court ruled that mortgage payments made during a marriage can be considered when calculating compensation for a spouse who primarily dedicated themselves to domestic work and family care.
This ruling applies even if the property was acquired before the marriage, provided that mortgage installments were paid during the matrimonial period. The measure aims to address economic imbalances caused by gender roles, recognizing that domestic labor can limit a spouse's ability to generate independent income. The compensation is not an automatic division of property or a transfer of ownership, but a financial provision determined by the specific circumstances of each case.
