Spanish Supreme Court protects pension balances from traffic fine seizures
The Spanish Supreme Court has ruled that the Tax Agency cannot seize the remaining balance in a bank account used for receiving pensions to pay for traffic fines. The decision establishes that funds remaining in an account after a pension is deposited do not automatically convert into seizable savings.
The case originated when the Tax Agency attempted to collect 4,262.51 euros in traffic sanctions by seizing 52 euros from a retiree's account. While lower courts in Madrid initially ruled that the leftover balance from previous months constituted seizable savings, the Supreme Court overturned this decision.
The court reasoned that the legal protection of wages and pensions is intended to guarantee the subsistence and basic needs of the debtor and their family. Because essential expenses such as utilities, taxes, and community fees are not always paid within the same month the pension is received, the remaining balance must maintain its protected status.
