Spanish Supreme Court rules against Mr. Wonderful in Ale-Hop imitation case

The Spanish Supreme Court has ruled against Mr. Wonderful in a long-standing legal battle against Ale-Hop regarding allegations of unfair competition. The court dismissed the company's appeals, confirming a previous decision by the Provincial Court of Valencia.

Mr. Wonderful had filed the lawsuit in 2021, claiming that Ale-Hop had imitated its distinctive commercial style, which includes simple illustrations, humanized objects and animals, brief positive messages, and a recognizable color palette. The plaintiff sought damages, the removal of products, and fines, arguing that such imitation created a risk of consumer confusion and exploited their brand reputation.

The Supreme Court determined that aesthetic similarity alone does not constitute unfair competition. The ruling emphasized that for such a claim to succeed, there must be a proven real risk of confusion or improper exploitation of reputation. The court noted that in a market with multiple competitors and aesthetic trends, imitation is generally permitted unless specific exceptional circumstances of unfairness are met.
