Spanish Supreme Court rules Ironlock Sistemas ERTE unjustified
The Spanish Supreme Court has dismissed an appeal by Ironlock Sistemas, S.L.U., upholding a previous ruling by the National Court that declared the company's Temporary Employment Regulation File (ERTE) unjustified.
The legal dispute was initiated by a collective conflict involving the FTSP-USO, FeSMC-UGT, and CCOO del Hábitat unions. The measure had affected 122 workers through the total suspension of their employment contracts.
The court determined that the company failed to provide sufficient evidence of the economic or productive causes required to justify the suspension. The ruling emphasizes that the burden of proof lies with the employer and noted that the accounting documentation provided lacked necessary auditing to substantiate the alleged financial difficulties.
