Spanish Supreme Court rules on community fee debt prescription

The Spanish Supreme Court has confirmed that unpaid community fees are subject to a five-year statute of limitations. Under Article 1966.3 of the Civil Code, these periodic payments must be claimed within five years. Crucially, the prescription period applies to each individual installment separately, starting from the moment that specific amount became due, rather than applying to the total accumulated debt from the first instance of non-payment.

When purchasing property, buyers are advised to look beyond current outstanding debts. Even if a seller is up to date with payments, the community may have already approved extraordinary expenses for repairs or renovations that have not yet been collected. In Catalonia, the Civil Code requires community certificates to disclose not only pending debts but also approved ordinary and extraordinary expenses and contributions to the reserve fund, even if they are not yet due. Experts recommend requesting updated debt certificates and investigating planned maintenance works to avoid unexpected financial obligations.
