Spanish Supreme Court sets five-year limit on unpaid community fees
The Spanish Supreme Court has reaffirmed that unpaid community fees are subject to a five-year statute of limitations. According to the court's doctrine, each individual fee has its own specific period, meaning communities must act within five years of a payment becoming due to ensure they can legally demand it.
This limitation period can be interrupted, for example, through an extrajudicial claim such as a burofax. If a community fails to take action within this timeframe, certain older debts may become uncollectible.
Beyond financial disputes, community living continues to face various social challenges. Recent rulings have addressed usage rights, such as allowing communities to prohibit owners of garages or commercial premises without a residence in the building from using the swimming pool. Other common conflicts include noise, improper use of common areas, and the impact of tourist rentals on resident coexistence.
