Spanish traffic laws on motorcycle passenger mobile phone use

Spanish traffic regulations distinguish between the responsibilities of a motorcycle driver and their passenger regarding mobile phone use. According to the Dirección General de Tráfico, specific prohibitions against using a mobile phone while driving apply exclusively to the person in control of the vehicle.

Consequently, a passenger using a phone to check messages, take photos, or record videos does not automatically trigger the same sanctions as the driver, as they do not exercise control over the vehicle. However, the driver remains primarily responsible for maintaining full attention on the road to ensure safety, as the DGT classifies mobile phone use as one of the most dangerous distractions while operating a motorcycle.
