Sparkassen association pursues trademark protection against similar logos

The Deutsche Sparkassen- und Giroverband (DSGV), the central body for Sparkassen trademark rights, is currently taking legal action against several financial institutions whose branding closely resembles the well-known red 'S' logo.

Publicly documented cases include the Cologne-based fund house Sauren, which was provisionally prohibited from using its new logo by the Hamburg Regional Court, and the Munich broker Scalable Capital, which has been requested to change its logo. Additionally, reports indicate that the DSGV has approached Sutor Bank in Hamburg and Sozialkasse in Cologne regarding potential rebranding, though both institutions have reportedly resisted.

The disputes raise legal questions regarding the extent of trademark protection for highly recognizable symbols and whether protection requires a concrete risk of confusion or merely the evocation of associations with the original brand.
