Split Administrative Court overturns Zadar municipal fee decision

The Administrative Court in Split has annulled a decision by the Zadar County regarding a communal contribution dispute involving Portada Zadar. The developer, which is completing a 172-apartment complex on the former Kemoplast site, had challenged a demand for €574,497.72 in fees.

The court ruled that the county failed to sufficiently clarify facts regarding the volume of previously demolished factory buildings and their impact on the final calculation. While the ruling does not exempt Portada from payment, it mandates that the county re-evaluate the appeal and apply the law correctly based on established facts. The final amount owed remains undetermined.

This dispute stems from complex land and project changes dating back to 2008. The city had previously calculated a total contribution of €704,901.59, deducting €130,403.87 from prior payments, leaving the contested balance.
