Stake Brasil's operating injunction overturned by TRF3

The Tribunal Regional Federal da 3ª Região (TRF3) has overturned a preliminary injunction that allowed the online betting platform Stake Brasil to continue its operations. The decision, signed by TRF3 President Judge Johonsom Di Salvo, follows an appeal by the Advocacia-Geral da União (AGU).

The ruling addresses a provisional measure that had prohibited the exploitation and advertising of online betting in Brazil. The judge argued that allowing only one specific platform to operate while others remain restricted would create regulatory asymmetry, potentially undermining the government's public policy.

Stake Brasil had previously secured a court injunction that was intended to protect its operations until October 25, 2026. The legal battle over the constitutionality of the betting ban is currently being reviewed by Minister Luiz Fux at the Supreme Federal Court (STF), following petitions from industry groups including the Associação Nacional de Jogos e Loterias (ANJL) and the Instituto Brasileiro de Jogo Responsável (IBJR).
