Germany proposes new protections for domestic violence victims

German Federal Justice Minister Stefanie Hubig (SPD) has introduced a draft law aimed at improving protections for victims of domestic violence. A primary focus of the proposal is to facilitate easier spatial separation from perpetrators by allowing victims to exit joint rental agreements without the perpetrator's consent.

Under the proposed legislation, victims could claim that the perpetrator covers rental costs, utilities, and potential damages incurred after the victim has moved out. The reform seeks to address the legal and financial hurdles that often prevent victims from securing a safe, independent living situation.

Additionally, the draft expands legal protections to include the victim's dependents, such as children or elderly relatives. Family courts would be empowered to issue contact and restraining orders for these individuals automatically, without requiring a separate application. This comes amid reports of rising domestic violence cases in Germany, with 2024 seeing a record high of approximately 266,000 reported victims.
