Stellantis Vigo ordered to revoke worker's shift change by court

The High Court of Justice of Galicia (TSXG) has ordered Stellantis Vigo to revoke a shift change imposed on a long-term employee. The worker, a 58-year-old with 30 years of service, had requested workplace adaptations due to health issues, including bilateral carpal tunnel syndrome and sleep apnea.

In March 2025, the company moved the employee to night and weekend shifts, claiming no other vacancies were available to accommodate his health needs. While a lower social court initially dismissed the worker's lawsuit, the TSXG overturned that decision. The high court ruled that while there was no substantial modification of working conditions or violation of fundamental rights, the company failed to correctly apply occupational risk prevention regulations.

The court noted that medical reports advised against night shifts due to the increased physical strain. It emphasized that the burden of proof lies with the employer to demonstrate that a new shift is adapted to the worker's health, rather than the worker proving it is not. Consequently, the court declared the shift change “unjustified” and ordered the company to reinstate the worker to his previous schedule.
