STJ suspends nationwide lawsuits over Airbnb rentals in condominiums
The Superior Tribunal de Justiça (STJ) has ordered a nationwide suspension of all legal proceedings regarding the legality of short-term rentals in residential condominiums via platforms such as Airbnb. The decision, made by the Court's Second Section, designates the controversy as 'Tema 1.443' under the rite of repetitive resources.
The central legal question is whether a condominium's convention, which specifies 'exclusively residential use,' is sufficient to prohibit short-term rentals, or if an explicit prohibition must be included in the document. The suspension aims to prevent conflicting judicial decisions across Brazil while the STJ works to establish a uniform, binding precedent.
Relator Minister Raul Araújo noted that the court has already identified approximately 50 different decisions on the matter. While the suspension halts current individual and collective lawsuits, it does not establish a new rule immediately. The final ruling will provide legal certainty for property owners, residents, and condominium managers nationwide.
