Stuttgart court rejects Linke injunction against Manuel Hagel
The Administrative Court of Stuttgart has rejected an urgent injunction filed by the Berlin state association of the Left Party (Die Linke) against Baden-Württemberg Interior Minister Manuel Hagel. The party sought to prohibit Hagel from making specific political statements regarding the party's impact on internal security.
The dispute arose after Hagel referred to a Left Party candidate as a ‘left-wing clan mayor’ and claimed the party was ruining internal security. Hagel had also suggested that Berlin police officers could relocate to southwestern Germany following the party's electoral success.
The court ruled that Hagel’s comments did not constitute official statements made in his capacity as Interior Minister, which would be subject to requirements of neutrality and objectivity. Instead, the court determined he was acting as a party politician participating in a political debate. Consequently, the remarks are protected under the scope of freedom of expression and cannot be attributed to the state of Baden-Württemberg as an official governmental intervention.
