Subhash Chandra: NCLT approves Rs 6.5 crore repayment plan amid 99.97% debt haircut

The National Company Law Tribunal (NCLT) has approved a repayment plan for Essel Group founder Subhash Chandra in his personal insolvency proceedings. Under the plan, Chandra will pay approximately Rs 6.5 crore to settle admitted creditor claims totaling roughly Rs 22,006 crore. This settlement represents a haircut of nearly 99.97 percent for the lenders.

The decision, rendered by NCLT Member Nilesh Sharma acting as a third member to resolve a previous split verdict, follows a repayment proposal that received 80.81 percent support from creditors. The tribunal noted that the plan was based on the limited value of Chandra's personal assets and that dissenting creditors were unlikely to recover more by rejecting it.

Several major financial institutions, including LIC Housing Finance, HDFC Bank, Axis Bank, and Canara Bank, opposed the plan, arguing the recovery was negligible. HDFC Bank has indicated it is exploring an appeal at the National Company Law Appellate Tribunal (NCLAT).

Subhash Chandra’s office has clarified that the Rs 22,006 crore figure refers to claims for which he acted as a personal guarantor for corporate loans, rather than money he personally borrowed. The office also disputed allegations that the voting process was skewed by associate entities, stating that the companies involved do not meet the statutory definition of associates under the Insolvency and Bankruptcy Code.
