Suffolk County ordered to issue permit for Holtsville battery plant

A New York state Supreme Court justice has ordered Suffolk County to issue a permit for a battery storage plant in Holtsville. The ruling rejects the county’s argument that the facility’s containers of toxic material required a special variance.

Justice Christopher Modelewski issued a five-page decision ordering the county to provide the permit within 10 days to facilitate construction. The plant, known as Holtsville Battery Storage, is being developed by Savion, a subsidiary of Shell.

Suffolk County has filed a notice of appeal to the state Appellate Division. This legal challenge could potentially delay Savion’s construction plans at the Morris Avenue site for several months.
