SUNAFIL proposal seeks unified national labor inspection authority

Deputy Carlos Yalta Sotelo has introduced Bill No. 00271-2026-2031-CD, which proposes consolidating the National Superintendency of Labor Inspection (SUNAFIL) as the sole national authority for labor inspection and sanctions. The proposal seeks to grant SUNAFIL jurisdiction over all employers regardless of company size, number of employees, or geographic location.

The initiative follows the expiration of Law No. 30814 on July 10, 2026, which had temporarily allowed SUNAFIL to inspect microenterprises. Since July 11, regional governments have resumed these inspection responsibilities, creating a divided system. Yalta argues that a single national authority is necessary to ensure common technical criteria and clear rules for both workers and employers.

Under the proposed law, regional governments would not lose all involvement; they would retain roles related to the promotion of rights, prevention, orientation, and training.
