Superior Military Court accepts homophobia charges against 10 people
The Superior Military Court (STM) has accepted a complaint against ten individuals accused of homophobia directed at a Brazilian Air Force corporal. The decision follows an appeal by the Military Public Prosecutor's Office (MPM) regarding an incident that occurred in August 2024.
The case originated after the victim shared photos of himself and his husband during a graduation ceremony. These images were subsequently shared in WhatsApp groups, where they were met with homophobic slurs and mockery. The emotional distress caused by the harassment required the victim to seek medical attention at the Brasília Air Force Hospital.
While a lower court had previously only accepted charges against active-duty military personnel, the STM overturned this ruling. The court ruled that the charges against civilians and former military members will also proceed, following the MPM's argument that the conduct constitutes a military crime by extension under the Military Penal Code. The court clarified that this decision is a procedural step to investigate individual responsibilities and does not constitute a final conviction.
