Supreme Administrative Court upholds Varna cadastre chief's suspension

The Supreme Administrative Court has upheld the decision to suspend Krasimira Bozhkova-Katalieva from her position as head of the Varna Cadastre. The suspension is linked to the "Baba Alino" case, involving allegations of insufficient oversight regarding illegal construction and buildings in the area.

While the court's decision is final regarding the immediate suspension, it does not yet rule on the legality of her ultimate dismissal. The court noted that, by law, appeals by civil servants against disciplinary acts do not automatically halt their execution unless significant or irreparable harm is proven, which was not the case here.

Bozhkova-Katalieva has contested the allegations, arguing that the cadastre's role is to register existing structures based on official documentation rather than to police the legality of constructions. She stated, "The cadastre does not issue construction permits, the cadastre does not check a construction, mainly whether it is legal or illegal. We are an organ that registers what is already on site."

The legal dispute continues as the courts move toward a substantive ruling on whether the disciplinary dismissal was lawful.
