Supreme Court of Greece issues rulings on banking claims and labor testimony
The Supreme Court of Greece has issued two significant rulings addressing procedural protections and the validity of judicial evidence.
In a case originating from Veria, the Court examined a dispute between an agricultural cooperative and a liquidator for the Agricultural Bank of Greece. The ruling clarifies the conditions for appellate review regarding compulsory enforcement, emphasizing that for a claim to be reviewed by the Supreme Court, it must have been properly raised and substantiated before the court of first instance.
In a separate matter involving a labor dispute in Komotini, the Supreme Court overturned a conviction for false testimony. The case began when a secretary filed a complaint regarding unpaid wages and social security contributions. The court addressed whether a conviction for false testimony could be sustained when the underlying testimony in question was allegedly not recorded in the official trial minutes.
