Supreme Court of India rules in favor of homebuyers in real estate disputes

The Supreme Court of India has issued significant rulings protecting homebuyers from developer-related penalties and deceptive marketing practices in two separate real estate cases.

In the case involving Granite Gate Properties Private Limited, the Court directed the New Okhla Industrial Development Authority (NOIDA) to waive time-extension penalties imposed due to delays caused by the original developer. The Court ruled that homebuyers and successful resolution applicants should not be burdened with costs stemming from the previous developer’s failures, particularly as homebuyers had pooled their own funds to continue construction during the insolvency process.

In a separate matter concerning the DLF Primus project in Gurugram, the Supreme Court observed substantial deviations from the project’s original layout and brochures. The Court noted that a significant portion of a promised 24-metre-wide road had been replaced by green patches or used for parking. The Bench emphasized that developer brochures are binding promises rather than mere marketing material, and the project must be brought into conformity with the representations made to consumers.
