Supreme Court of Nigeria rules on Aguika land ownership dispute

The Supreme Court of Nigeria has addressed a significant land dispute regarding the ownership of Aguika land. The case involves competing claims between communal ownership by the Umuagu Inyi community clans and the exclusive ownership claimed by the Respondents.

The Appellants argued that the land was acquired through the conquest of the Nneoma People following a war to avenge the death of the Respondents’ progenitor, Onara. They asserted that an oath was sworn to share any booty recovered from the war equally among all Umuagu Inyi clans. While the land was initially used for communal farming with the Respondents acting as caretakers, the Respondents have since claimed exclusive ownership.

The Respondents acknowledged the land was acquired through conquest but denied the existence of an oath requiring the land to be shared among all clans, suggesting instead that different parcels were allocated for various purposes.
