Supreme Court restores GST bail petition after procedural irregularities

The Supreme Court of India has restored a bail petition involving a GST prosecution for fresh hearing following allegations of procedural irregularities. The case involves Mohammed Kamran, proprietor of M/s MK Traders, who is accused of issuing invoices without supplying goods, falsifying documents, and fraudulently availing input tax credit, resulting in an alleged revenue loss of ₹43,08,22,936.

The Court's decision follows a challenge to a bail order granted by the Karnataka High Court during its winter vacation. The prosecution argued that the bail was obtained through an expedited hearing without adequate notice to the Department’s Standing Counsel and that the respondent failed to disclose adverse judicial orders during parallel proceedings. While the petition is restored for a new hearing, the interim bail for the accused remains in effect.
