Supreme Court revises PT Timah corruption state loss to Rp28 trillion

The Indonesian Supreme Court (MA) has revised the state financial loss calculation in the PT Timah Tbk corruption case involving former Production Operations Director Alwin Albar. The court ruled that the previously cited figure of approximately Rp300 trillion does not fall entirely under the category of state financial losses related to corruption.

Presiding Judge Prim Haryadi clarified that the total amount consists of two distinct categories: Rp28.93 trillion in state financial losses due to overpayments for metal processing equipment rentals without adequate feasibility studies, and Rp271.06 trillion in environmental and ecological damages. The court emphasized that environmental damage is governed by a different legal regime and cannot be automatically classified as state financial loss in a corruption criminal case.

The judge suggested that the Rp271.06 trillion in environmental losses should be pursued through separate legal proceedings under environmental law to ensure timely ecological recovery. This case has gained significant public attention due to its connection to other high-profile suspects, including Harvey Moeis.
