Supreme Court rules employers cannot unilaterally reduce remote work
The Supreme Court has ruled that employers cannot unilaterally reduce an employee's remote work days without their prior consent. The court established that business needs alone do not grant a company the authority to change previously agreed-upon remote work arrangements.
This ruling means that employers must negotiate individually with each employee to change terms, such as the required amount of office presence. The case originated from a group of workers with recognized disabilities who had a settlement agreement allowing for 100% remote work until the end of 2024. When management attempted to reduce this to 75% remote work, several employees refused the change. The court ultimately ruled in favor of the employees, preventing the reduction of remote work for those who opposed it.
