Supreme Court rules on MACP financial upgradation limits

The Supreme Court of India has issued a decisive ruling regarding the Modified Assured Career Progression (MACP) scheme for central government and railway employees. The court clarified that financial upgradation under the MACP scheme cannot exceed the grade pay ceiling of an employee's promotional hierarchy.

The dispute primarily involved the railway Guards category. Following the merger of pay scales under the 6th Central Pay Commission, employees argued that despite receiving promotions, their grade pay remained stagnant, entitling them to higher grade pay under MACP. However, the Supreme Court upheld the government's position, stating that if an employee has received a regular promotion within their cadre, they are not eligible for additional financial upgradation under MACP that exceeds the established promotional post ceiling.

The Railway Board has shared this judgment, noting that MACP upgradation must adhere to the grade pay limits of the promotional hierarchy, thereby upholding the provisions of RBE No. 142/2012.
