Supreme Court rulings in Argentina and Chile address debt and competition laws

In Argentina, the Supreme Court has rejected the application of a 36% annual interest rate to a customs debt denominated in U.S. dollars. The court ruled that the rate, established by a 2010 Ministry of Economy resolution, was disproportionate because it was calculated based on peso-denominated operations. The case involves the textile company Colecction SRL, which faced customs claims after an investigation determined that goods imported from Brazil in 2005 did not meet Mercosur origin requirements. While the court upheld the obligation to pay the tax difference, it revoked the interest ruling and ordered a new decision on that specific point.

In Chile, the Free Competition Defense Tribunal (TDLC) dismissed an appeal filed by the National Consumer Corporation (Conadecus). The appeal sought to challenge a decision regarding the regulation of large economic groups and the limits on pyramidal structures and cross-participation between banking and real economy sectors. The TDLC ruled the appeal inadmissible, stating that its regulatory propositions are recommendations to the Executive branch rather than judicial sentences that establish rights or obligations, making them ineligible for standard legal claims.
