Supreme Court rulings reshape pension benefits in Spain and Mexico

Spain's Supreme Court (Tribunal Supremo) issued sentence 337/2026 on 30 March, rejecting the practice of applying the child‑birth complement to the reduced pension amount of retirees who continue working. The court ruled that the complement must be calculated on the initial pension base, raising the monthly amount for the case from €34.27 to €68.53. The decision applies to the original legal provision on demographic supplements and could affect thousands of active retirees, with more than 1.5 million pensions already receiving the complement in Spain.

Mexico's Supreme Court (SCJN) upheld the constitutionality of a maximum cap on pension payments for IMSS beneficiaries who receive both a retirement pension and a risk‑of‑work pension. The cap is set at the salary level of a “Médico Familiar 8.0 horas” (approximately 12,844 pesos per month) and is intended to preserve the financial sustainability of the system while maintaining a dignified level of social security for pensioners.
