César Duarte case: Mexico's Supreme Court to define extradition limits

The Supreme Court of Justice of the Nation (SCJN) has taken control of two amparo lawsuits filed by former Chihuahua governor César Duarte Jáquez. The court aims to establish a legal precedent regarding the 'rule of specialty' within the extradition treaty between Mexico and the United States.

Duarte was extradited from the U.S. to Mexico in June 2022 to face charges of embezzlement and criminal association involving more than 96 million pesos. The legal dispute arose when Mexican authorities sought authorization from the U.S. to prosecute him for additional crimes. Duarte's defense argues that the diplomatic process used to obtain this consent violated his right to a hearing and legal certainty.

A federal judge in Chihuahua previously ruled in favor of Duarte, annulling an August 2023 hearing and the resulting arrest warrant. Federal authorities have appealed this decision, contending that the diplomatic request for additional charges is a matter of international cooperation and does not necessitate a formal hearing for the extradited individual.
