Supreme Court to hear custody battle between surrogate and intended parents

A high-profile legal battle over the custody of a newborn has reached the U.S. Supreme Court. The dispute involves surrogate mother McKenna West and the intended parents, Nausheen Gilkar and Omar Ahmed.

The conflict began after doctors diagnosed the fetus with hypoplastic left heart syndrome (HLHS), a serious congenital heart condition, during pregnancy. Gilkar and Ahmed requested that West undergo an abortion, a request she declined. Following the birth, West sought custody or conservatorship, expressing concerns that the intended parents might not authorize necessary life-saving surgeries for the infant.

In a recent filing, Gilkar and Ahmed have accused West of “fabricating” an emergency and conducting a “publicity tour” that could jeopardize the child's medical care. The case involves complex legal questions regarding parental rights and the autonomy of surrogates. The infant is currently receiving treatment in a Dallas hospital, following legal interventions in Texas.
