Supreme Court to hear government appeal over Sean Brown inquiry

The Supreme Court is set to hear a government appeal regarding a court order to hold a public inquiry into the 1997 murder of Sean Brown. Mr. Brown, the chairman of Bellaghy Wolfe Tones GAA Club, was kidnapped and killed by loyalist paramilitaries in Northern Ireland. No one has ever been convicted for the killing.

The Secretary of State for Northern Ireland is challenging a Court of Appeal decision that affirmed a High Court ruling compelling the government to conduct the inquiry. The Court of Appeal previously ruled that the failure to hold an inquiry was unlawful. The government's appeal, initiated by the predecessor to the current Secretary of State, centers on the constitutional principle of whether the judiciary or the government should have the authority to order public inquiries.

Inquest proceedings in 2024 revealed that intelligence linked more than 25 people to the murder, including several state agents. Allegations were also made in court regarding the temporary suspension of surveillance on a suspect during the evening of the killing.
