Superior Electoral Court orders removal of Flávio Bolsonaro video linking Lula to crime

The Superior Electoral Court (TSE) has ordered the removal of a video published by Senator Flávio Bolsonaro that links President Luiz Inácio Lula da Silva to criminal organizations, specifically the Primeiro Comando da Capital (PCC) and Comando Vermelho (CV). The decision, reached by a five-to-two vote in a virtual plenary session, overturns a previous individual decision by Justice Nunes Marques that had rejected the removal request.

The legal action was initiated by the Federação Brasil da Esperança, a coalition comprising the PT, PC do B, and PV parties. The coalition argued that the video constituted negative early electoral propaganda and falsely associated the president with organized crime. In addition to removing the video, the TSE ordered the social media platform X to take down the content.

Separately, the court declined to rule on a motion by Justice André Mendonça that sought to compel the Federação Brasil da Esperança to provide recordings and financial documents related to its 8th National Congress and the 'Porta-Vozes de Lula' project. The TSE determined that the initial distribution of this specific case was improper and ordered it to be redistributed to the appropriate members of the court.
