Supreme Federal Court to resume Ficha Limpa Law judgment in September

The Brazilian Supreme Federal Court (STF) is set to resume its judgment on changes to the Ficha Limpa Law between September 11 and 18. Minister Gilmar Mendes has returned the case to the virtual plenary after previously requesting a stay of proceedings.

The legal challenge concerns reforms approved by Congress in 2025 that modify how ineligibility periods for convicted politicians are calculated. Key changes include shifting the start of the eight-year ineligibility period to the moment of mandate loss or resignation, rather than the end of the term, and establishing a 12-year cap on accumulated ineligibility periods for administrative misconduct.

Ministers Cármen Lúcia and Luiz Fux have already voted to declare these changes unconstitutional, arguing they weaken the legal framework for political morality and represent a regression in administrative probity. The ruling could significantly impact upcoming elections by determining the eligibility of various political candidates.
