Brazilian courts implement new GAACTA gratifications for commissioned staff
Several high-level Brazilian courts have implemented a new gratification known as GAACTA (Gratificação pelo Exercício de Atividades de Alta Complexidade, Técnica e Administrativa) for employees in commissioned positions.
The Supreme Federal Court (STF) has authorized a benefit of up to 22.5% for approximately 276 staff members, including cabinet chiefs. This measure is expected to cost around R$ 5,300 per beneficiary monthly. While the STF notes the benefit is subject to the constitutional salary cap, it is exempt from income tax and social security contributions.
Similar measures have been adopted across the judiciary. The Superior Court of Justice (STJ) implemented a 15% gratification in May. The Superior Labor Court (TST) recently authorized a 15% increase for staff in the first and second instances of Labor Justice.
Collectively, these gratifications across various superior courts and the Federal Justice system are estimated to cost at least R$ 23.8 million per month. The Federal Justice system currently sees the highest impact, with R$ 11.75 million monthly for 2,734 employees.
