Surrogacy legal risks highlighted following Sun Yuchen and Jing Tian dispute
Following reports of a dispute between Sun Yuchen and actress Jing Tian regarding a failed surrogacy arrangement, legal experts are highlighting the significant risks associated with international surrogacy contracts.
According to lawyer Zhang Yichen, surrogacy contracts are considered invalid in Taiwan as they violate public order and reproductive laws. This invalidity means that parties may struggle to recover paid fees or enforce contractual terms.
Key legal challenges include the difficulty of recovering funds sent to overseas accounts, the inability of contracts to override a surrogate mother's bodily autonomy, and complex legal hurdles regarding parental rights and inheritance for the child once born.
