Swedish consumer rights regarding car and property purchases
In Sweden, the right to cancel a purchase depends heavily on the type of transaction and the method of agreement. For used car purchases from a dealer, there is generally no statutory right of withdrawal if the contract is signed in person. However, under the Distance Contracts Act, consumers may have a 14-day right of withdrawal if the purchase is conducted remotely, such as via telephone or the internet.
Regarding real estate, canceling a housing purchase is a significant legal consequence reserved for material breaches of contract. This includes situations where a seller provides a defective property or fails to move out on time, or if a buyer fails to make payments. Cancellation aims to return both parties to their original positions, involving the return of the property and the purchase price. This differs from contract conditions, such as loan or inspection clauses, which allow a purchase to lapse without a breach of contract.
