Swedish Labor Court declines appeal in Energy Agency dismissal case

The Swedish Labor Court (Arbetsdomstolen) has declined to grant leave to appeal in a case involving a former employee of the Swedish Energy Agency (Energimyndigheten). The individual, a member of the climate group Rebellmammorna, lost her position after the agency determined her activism was incompatible with her security clearance.

The decision upholds a previous district court ruling that cleared the Energy Agency of violating the employee's freedom of expression. Fackförbundet ST, the union representing the employee, expressed surprise at the decision, stating that the legal status regarding what state employees can do in their private time remains unclear. The union highlighted the tension between individual freedom of speech and the Security Protection Act.

In addition to the legal proceedings, the Swedish Committee on the Constitution (Konstitutionsutskottet) is conducting a review of the matter following allegations of potential political interference in the agency's handling of the termination.
