Syros restaurant fine overturned after fish freshness dispute
The Greek Direction for Dispute Resolution (DED) has overturned a 500 euro fine imposed on a restaurant in Ermoupoli, Syros, after tax inspectors used the physical appearance of fish to allege tax evasion.
During a routine inspection in July 2024, officials examined 3.5 kilograms of grouper valued at 98 euros. Although the business provided an invoice for an 8.3-kilogram purchase dated July 15, inspectors claimed the fish was ‘too fresh’ to match the documentation. They based this assessment on the fish’s ocular condition and rigor mortis, suggesting the stock had been purchased more recently than the invoice indicated.
The restaurant contested the fine, arguing the fish was part of the documented stock. The DED ultimately canceled the penalty, ruling that the inspectors’ findings relied solely on visual observation without providing objective or scientific evidence to substantiate the claim of a tax violation.
