Taiwan Court Warns Against Using AI for Legal Pleadings
In a 2026 civil judgment (Taoyuan District Court case 115‑2026‑867), the presiding judge opened the decision by explicitly stating “do not ask AI, do not use AI to draft pleadings.” The plaintiff, a non‑lawyer, had copied a consumer‑grade AI‑generated draft into the court filing, and the suit was dismissed.
Lawyer Lin Shang‑lun argues the ruling does not reject AI wholesale but highlights that AI remains a tool for professionals, not a shortcut for laypersons. He explains technical limits such as token caps and “lost‑in‑the‑middle” errors that can cause critical omissions, as well as the risk of fabricated content (“hallucinations”) when the model lacks a legal knowledge base.
