Taiwan courts limit real‑estate agent liability for hidden property defects
Buyers who discover problems such as ceiling leaks, undisclosed taxes or structural flaws after a property hand‑over often seek compensation from the real‑estate agent. Taiwanese courts, however, frequently dismiss these claims, ruling that agents are not liable for defects that cannot be identified through ordinary visual inspection. The legal duty of agents is limited to investigating and disclosing matters that are reasonably observable or documented in the property description, such as overt water leakage, building inclinations or known encroachments. Tax‑related disputes are also limited to cases where the agent explicitly promised tax‑consulting services or provided false information, placing the burden of proof on the buyer. Professionals advise consumers to verify tax matters directly with authorities and to obtain legal or accounting advice for complex issues.
