Tan Kian's testimony on alleged Rp40 billion bribe faces legal scrutiny

Legal experts are debating the validity of examination reports (BAP) involving property businessman Tan Kian, regarding allegations that Rp40 billion was given to officials within the Attorney General's Office. The issue surfaced during a pretrial hearing filed by former Jampidsus official Febrie Adriansyah concerning alleged money laundering.

Prof. Jamin Ginting, a law professor from Pelita Harapan University, argued that Tan Kian's testimony is legally weak because it constitutes ‘de auditu’ evidence. He noted that Tan Kian did not personally witness or experience the handover of the funds to the officials, meaning the information is based on hearsay rather than direct observation.

In contrast, prosecutor observer Kamilov Sagala maintains that the BAP holds legal value as it is an official result of an investigation signed by the relevant parties. Experts suggest that the individuals named in the reports must provide clarification to prevent potential defamation.
