TAR Emilia-Romagna suspends Modena business closure order
The TAR Emilia-Romagna has issued a precautionary suspension regarding a decision by the Questore of Modena to close a public establishment for ten days. The closure was ordered following an incident involving the participation of minors in public gaming.
The legal dispute centers on a conflict of jurisdiction between the powers of the Questore under Article 100 of the Consolidated Law on Public Safety (TULPS) and the specific authority of the Customs and Monopolies Agency to impose sanctions for violations of gambling prohibitions for minors.
The business owner filed the appeal against the Ministry of the Interior and the Modena Police Headquarters, with the Customs and Monopolies Agency identified as an interested party. The original decree, issued on October 5, 2026, mandated the suspension of the establishment's authorization.
