TAR Lazio upholds Ciampino ban on slot machines
The TAR Lazio has rejected a precautionary request from a company seeking to overturn a ban imposed by the Municipality of Ciampino on the operation of slot machines and entertainment devices. The court ruled that the mere submission of a certified notification of commencement of activity (SCIA) is insufficient to authorize such operations; instead, specific authorization under Article 86 of the TULPS is required.
Additionally, the court upheld the municipality's enforcement of distance requirements established by Lazio regional law. The judges determined that the gaming facility was located too close to sensitive locations, including a study center that organizes regular courses for students aged 15 to 19 and a foster home. The court concluded these structures qualify as locations frequented predominantly by young people, necessitating the required distance.
