TAR Piemonte rules on student evaluation and DSA measures

The TAR Piemonte administrative court has issued a ruling regarding the academic failure and non-promotion of a student with Specific Learning Disabilities (DSA). The decision, published on August 21, 2026, addresses the relationship between the application of a Personalized Didactic Plan (PDP) and student responsibility.

According to the court's ruling, simply proving that a school failed to follow the prescribed PDP measures is not sufficient to overturn a negative evaluation. Instead, it must be demonstrated that the correct application of those measures would have concretely influenced the student's academic results and the subsequent decision not to promote them to the next grade.

The National Coordination of Teachers of Human Rights (CNDDU) has responded to the ruling, emphasizing that schools have precise legal obligations under Law 170/2010 and subsequent decrees to provide individualized interventions and compensatory tools. The CNDDU argues that if families are required to prove the impact of missing measures, schools must be equally capable of documenting how the PDP was effectively implemented throughout the school year.
